FACTS

Wisconsin’s Supreme Court struck down Governor Tony Evers’ stay-home order in a ruling made earlier this week. Republican legislators had brought the case to the Wisconsin Supreme Court, claiming that the governor could not further extend the stay-home order without legislative approval. The conservative judges ruled against the Democratic governor’s administration in the first case like it since the coronavirus pandemic. The 4-3 decision concluded that Health Secretary Andrea Palm’s orders extended past the bounds of her authority.

The Republican legislators, in their defense, said they asked for the justices to rule against the stay-home order but to stay the order for six days so they could devise a plan for proceeding. However, the justices declared the order struck down immediately.

Justice Rebecca Bradley stated “The people never consented to a single [unelected] individual having that kind of power.” The GOP lawmakers said that rather than one person making the decisions for millions of people, that responsibility would now be the joint effort of multiple persons and branches of government. They declared that the economic impact of ongoing lock-down would leave the state in “shambles.”

Lawyers representing Evers said that the state acted in accordance with laws that grant such powers in times of emergency. Justice Ann Bradley, who is liberal leaning, criticized the decision made just after top specialist Dr. Fauci warned the nation of rushing back to “normal” life. Governor Evers said that the different rules and regulations set up in counties and cities following the new ruling would cause confusion and chaos in citizens. Assistant Attorney General Colin Roth, representing Palm, declared that if the ruling were passed, it would be “absolutely devastating and extraordinarily unwise” for the State of Wisconsin.
